LITTLE ROCK, Ark. (Reuters) -
A unanimous Arkansas Supreme Court has thrown out the conviction of a man
arrested in his bedroom for drunken driving, court records showed.
A policeman tracked Michael Norris of Fayetteville, Arkansas, to his home after other motorists complained of a
hazardous driver identified as Norris. A woman opened the door to the officer, who went to Norris' bedroom and
arrested him after he failed a field sobriety test.
Norris appealed his conviction, citing his Fourth Amendment protection against unreasonable search and seizure. The
court agreed and dismissed the case in a ruling.
The court said society's interest in curtailing drunken driving did not nullify Norris' constitutional rights.
